APPLICATION FORM 

FOR THE EXERCISE OF DATA SUBJECTS’ LEGAL RIGHTS 

UNDER THE SCOPE OF LAW ON THE PROTECTION OF PERSONAL DATA

("APPLICATION FORM")

 

In Article 11 of the Law on the Protection of Personal Data No. 6698 ("Law"), rights are granted to data owners defined as personal data subjects (hereinafter referred to as the "Data Subject") to:

 

• Learn whether their personal data is being processed,
• Request information if personal data is being processed,
• Learn the purpose of processing personal data and whether they are used for this purpose,
• Know the third parties to whom personal data is transferred domestically or internationally,
• Request correction of incomplete or incorrect personal data,
• Request the deletion or destruction of personal data within the framework of the conditions set forth in Article 7 of the Law,
• Request notification of the above processes to third parties to whom the personal data has been transferred,
• Object to the occurrence of a result against oneself as a result of the analysis of processed data solely through automated systems,
• Demand compensation for damages in case of unlawful processing of personal data.

 

This Application Form has been prepared by Kuturk Crypto Asset Purchase and Sale Platform Joint-Stock Company ("KuCoin TR"), as the data controller, for you to exercise your rights under Article 11 of the Law as the Data Subject, as presented above.

 

You can submit your requests within this scope to us using the methods and procedures detailed below. In order to provide you with faster and more accurate information and to take more effective action in line with your requests, you can fill out the Application Form we have prepared for you and submit it to us.

 

  1. INFORMATION

 

Your application and our response to your application are stored and processed in our data recording environment for the purpose of exercising our right to defence or for the organization or management of applications. For these purposes, they are shared with our lawyers, our business partners acting as data processors, the Personal Data Protection Authority, the Personal Data Protection Board and other public institutions and organizations involved in the process and judicial authorities handling the process related to this application.

 

 

  2. APPLICATION PROCEDURE 

 

You can apply to KuCoin TR in person by signing and writing or by using your registered electronic mail (KEP) address, secure electronic signature, mobile signature or the electronic mail address you have notified to KuCoin TR before filling out this Application Form and registered in our system or through a notary. Depending on the nature of your request and your application method, additional information for identity verification (such as sending a message to your registered phone or calling you) may be requested by KuCoin TR to determine whether the application belongs to you and thus to protect your personal rights. For example, if you make your application via the e-mail address registered with KuCoin TR, we may contact you using another registered communication method at KuCoin TR to confirm whether the application belongs to you.

 

In case of a signed and written application, it is necessary for this application to be delivered to us. We will respond to your written application as soon as possible and within a maximum of 30 (thirty) days from the date of its delivery to us. For applications made through other methods, the date on which your application reaches us is considered the application date. If the information and documents you provide to us are incomplete or unclear, we will contact you to clarify your application.

 

In accordance with Article 13 of the Law and Article 5 of the Regulation on the Procedures and Principles of Application to the Data Controller, applications regarding these rights must be submitted to us in writing in Turkish.

  3. RESPONSE PROCEDURE TO YOUR APPLICATION

 

KuCoin TR will respond to your request in writing or electronically. In any case, within the framework of the relevant legislation, the following information will be included in our response to your application:

 

• Your full name
• If you are a citizen of the Republic of Turkey, your Turkish identification number 
• If you are a foreigner, your nationality, passport number, or, if available, your identification number
• Your residential or business address for notification purposes
• Your designated email address, if available
• Your telephone number and, if available, your fax number

If we prepare a written response to your application and our response document exceeds ten pages, a processing fee will be charged for each page beyond the tenth page, as stipulated in Article 7 of the Regulation on Application Procedure and Principles to Data Controller.
